About this policy and the information we collect

Agile MSP Pty Ltd (ABN 27 640 338 987), trading as Agile MSP, provides managed IT, co-managed support, consulting, cloud and infrastructure services, procurement and white-label technology delivery. This policy explains how we handle personal information about website visitors, customers, service partners, suppliers, authorised users and people making career enquiries.

Personal information means information or an opinion about an identified person, or someone who can reasonably be identified. This includes business contact details. We handle personal information in accordance with the privacy laws that apply to us, including the Privacy Act 1988 (Cth) and Australian Privacy Principles where applicable.

Information relevant to our work

  • Enquiries and relationships: names, roles, organisation details, email addresses, telephone numbers, service requirements and correspondence.
  • Service administration: authorised contacts, agreements, billing details and records of the work requested or performed.
  • IT support: user and device identifiers, account information, support tickets, technical logs, configurations and relevant screenshots or files.
  • Supported environments: personal information in email, applications, documents or backups that we need to access for an authorised support, migration, security or recovery task.
  • Career enquiries: contact details, experience, qualifications and other information you choose to provide.
  • Telephone communications: recordings of inbound and outbound calls made through RingCentral, as explained below.

Please do not send passwords, identity documents or sensitive personal information through general website enquiry forms. If these are needed for an agreed task, contact us to arrange an appropriate way to provide them. We collect sensitive information only where reasonably necessary and with consent, or where otherwise permitted or required by law.

How we collect, use and share information

We collect information when you contact us, request support, submit a website form, discuss services, enter an agreement or make a career enquiry. Information can also come from your employer, an authorised IT contact, a service partner or a supplier involved in the work. Technical information can be generated by the systems and support tools used in an agreed engagement.

You can make a general enquiry anonymously or using a pseudonym where practical. We may need to verify your identity or authority before discussing an account, accessing systems or delivering services. Without necessary information, we may be unable to complete your request.

How we use information

We use relevant information to respond to enquiries, assess requirements, deliver and administer services, investigate support issues, communicate about work, manage accounts, consider career enquiries, protect systems, resolve complaints and meet legal obligations. Additional uses must be permitted by applicable law.

Co-managed and white-label delivery

We can work alongside an internal IT team or deliver services under a partner’s brand. In these arrangements, we handle relevant information for the agreed work and follow authorised instructions, subject to our own legal obligations. The customer or partner’s privacy policy may also apply.

If your request concerns records held in your employer’s or another organisation’s systems, contact that organisation or your usual service provider first. You can also contact us for help identifying the appropriate route. A proposed business-owner transition does not itself authorise unrestricted transfer or unrelated use of client information.

Who receives information

Depending on the engagement, relevant information can be shared with authorised employees and contractors, nominated customer contacts, internal IT teams, white-label partners and suppliers needed to perform the work. These can include cloud, hosting, communications, backup, software-licensing and specialist-support providers. Information can also be disclosed to professional advisers, insurers, regulators or law-enforcement bodies where necessary and permitted or required by law. We seek to limit sharing to the purpose and the recipient’s role.

Marketing choices

Where we send marketing messages, we do so in accordance with applicable privacy and electronic-messaging requirements. You can opt out using an unsubscribe option in the message or by contacting us. Essential service, support and account communications are separate from marketing.

Overseas access, website activity and security

Our Philippines team

Our team in the Philippines has access to customer information as part of service delivery. This can include contact details, support records and information in customer systems relevant to the work being performed. Access is for authorised service responsibilities, not an unrestricted right to use customer information for other purposes.

We also use third-party technology and communications services, including RingCentral. A provider’s storage, processing and support locations depend on the service and configuration and can involve countries outside Australia. Please contact us to discuss service-specific data-location requirements before providing information or arranging access. We do not represent that all customer information remains in Australia. Applicable overseas-handling obligations and appropriate safeguards must be considered when information is shared.

Website activity and RingCentral call recording

We do not use website visitor tracking for analytics or advertising, and our website does not record support calls. This is separate from our telephone service: inbound and outbound calls made through RingCentral are recorded.

Call recordings are personal information and form part of our communication records. They can be used to review conversations, follow up requests and resolve service questions or disputes. The same privacy, access and retention principles in this policy apply to recordings. If you have concerns about recording, ask about alternative ways to communicate before sharing sensitive information. This policy does not replace any call-specific notice or consent required by law.

Website functionality, security and enquiry processing can involve technical information such as an IP address or system logs; this is distinct from analytics or advertising tracking. External websites linked from our site operate under their own privacy policies.

Storage, protection and retention

We hold information in the business and service systems used to manage enquiries, relationships and delivery, including relevant service-provider systems. We take reasonable steps to protect it from misuse, interference, loss and unauthorised access, modification or disclosure. Protection must be appropriate to the information and the risks involved; no internet service can be guaranteed completely secure.

We retain information for as long as reasonably needed for its purpose, including applicable legal, accounting and dispute-management requirements. When it is no longer required and the law permits, we take reasonable steps to securely destroy or de-identify it. Customer-system records and backups are also subject to agreed service requirements, retention settings and lawful instructions. Deletion from every backup may not be immediate.

We assess suspected personal-information breaches and take appropriate response steps. We notify affected individuals and regulators where required by applicable law, including the Notifiable Data Breaches scheme where it applies.

Your choices, privacy requests and complaints

Accessing or correcting your information

Contact us if you would like access to personal information we hold about you or believe it is inaccurate, out of date, incomplete, irrelevant or misleading. Give us enough detail to identify the relevant records. Do not send sensitive identity documents with your initial request; we will explain any identity or authority checks needed.

We respond within a reasonable period. If access or correction cannot be provided, we explain the lawful reason and available complaint options. There is no charge for making a request or seeking a correction. If a permitted access charge would apply, we explain it before proceeding.

How we handle complaints

Tell us what happened, the relevant service or interaction and how you would like us to respond. We will acknowledge your complaint, review the relevant information and explain our findings and any proposed action. We aim to respond within 30 days. If more time is needed, we will explain the delay and next steps.

If you are not satisfied with our response, or have not received a response after allowing a reasonable time, you can contact the Office of the Australian Information Commissioner (OAIC). The OAIC can explain whether your complaint falls within its jurisdiction and the next steps available.
